Global Director Trade Compliance (m/f/d)

The Director Trade Compliance will be primarily responsible for developing, executing, and managing the export and import trade compliance program globally.

This is a globally scoped position reporting directly to the General Counsel and indirectly to the Danaher (DHR) Life Science Platform Director of Trade Compliance.

The Director will oversee at least 2 direct reports located at the various Leica sites, with a view to achieve an organizational re-design of the entire Trade Ops/ Trade Compliance function(s), in conjunction with similar organizational changes being implemented at a platform level. The team size might prospectively grow over time.

The Director will work with the Platform Director to improve and execute all aspects of DHR´s trade compliance programs, including process design, periodic self-testing, training and education, and business strategy review.

Responsibilities include advising Operations, Business Unit and Sales staff, site general managers, and all LMS senior staff about trade compliance matters; providing trade compliance oversight to all activities at those sites; working collaboratively with all site leaders to ensure they have implemented effective compliance internal controls into their procedures and work instructions, and providing trade compliance training.

The location of the role is flexible across LMS` global footprint.

Your Responsibilities
  • Ensure compliance with domestic and foreign export and import requirements
  • Develop and deploy the DHR Life Science Platform and Leica Trade Compliance program(s) and procedures on import and export regulatory compliance
  • Consult with DHR and Platform Trade Compliance and Legal leaders, Leica Legal and Compliance colleagues, and outside counsel as needed to resolve complex trade compliance issues
  • Ensure legal compliance with trade laws and regulations, including appropriate licensing for shipments
  • Serve as the resident expert on U.S., EU and other international export/import requirements
  • Ensure company policies conform to Corporate Import and Export Policies.
  • Manage self-testing of LMS´ export/import compliance programs
  • Analyze and interpret requirements for compliance as they relate to:
  • Export Administration Regulations (EAR) of the U.S. Department of Commerce Bureau of Industry and Security (BIS)
  • EU, U.S. Customs and other applicable Government Agency rules and regulations
  • Conduct training on laws and regulations, as well as policy and procedures, to associates and new hires
  • Review, respond to, and escalate as necessary all government inquiries related to trade compliance
  • Manage internal and external audits and disclosures
  • Implement business systems and tools required to achieve legal and regulatory conformity, and to minimize business risk and liability exposure
  • Provide consultation to business units, global subsidiaries, sales, procurement, project managers, order management, etc. and resolve matters pertaining to export/import transactions
  • Oversee and provide guidance to the global trade organisations in their day-to-day compliance matters which are not limited to
The role is dual-facetted in nature. The Director will act as well as Rules of Origin specialist:

Being responsible for supporting compliance in four core customs areas: 1) preferential trade and special sales programs, 2) country of origin/marking, and classification and 3) will work closely with other Trade Compliance OpCo leads in providing subject matter expertise and 4) developing a Rules of Origin compliance program across the Life Sciences platform. In total you will work with at least six OpCo’s within the Platform.

Specific Role/Function Description
  • Partnering with other trade compliance leads, Supply-Chain and Manufacturing team members to evaluate products and manufacturing processes to determine preferential and non-preferential origin worldwide
  • Conducting and documenting manufacturing fact pattern review and country of origin determination analysis with Supply-Chain and Manufacturing
  • Reviewing, analyzing, documenting and maintaining rulings, formal decisions and other documents supporting country of origin determinations
  • Developing effective country of origin decisions, methodologies, and defense arguments globally
  • Conducting process and compliance reviews to maintain and improve accurate use of country of origin ERP tools
  • Conducting country of origin audits, testing, and developing countermeasures globally
  • Proactively identifying opportunities to improve processes, minimizing compliance risks and reducing costs
  • Developing, implementing and monitoring internal policies and procedures to support country of origin and marking compliance
  • Developing and conducting training to support internal education on core customs compliance matters
OUR EXPECTATIONS
  • Relevant academic degree
  • A minimum of 8-10 years in-house import/export administration
  • At least 2 – 3 years of supervisor or management experience
  • Fluency with WTO, U.S. and non-U.S. Customs country of origin rules and regulations, the regulations of other US and non-U.S. government agencies that impact non-preferential and preferential country of origin compliance and marking
  • Understanding of international agreements governing customs and trade compliance worldwide
  • Knowledge of EU and U.S. import and export control laws and regulations as they relate to:
  • Export Administration Regulations (EAR) of the U.S. Department of Commerce Bureau of Industry and Security (BIS)
  • U.S. Treasury Office of Foreign Assets Control (OFAC)
  • International Traffic and Arms Regulations (ITAR) of the U.S. Department of
  • Extensive understanding of applicable export, re-export and deemed licensing requirements
  • Able to work well in a collaborative, cross-functional team environment
  • Strong research, writing, analytical and communication skills
  • Commitment to integrity, ethics, and building strong relationships in a diverse setting
  • Proven project management experience
  • Must have excellent verbal and written communication skills and the ability to present regulatory topics to business audiences
  • Ability to interact with business units, marketing, sales personnel to understand technology and commercial requirements
  • Ability to influence across the company and to interact with persons at all levels
  • Fluency in English and preferably fluency in another relevant business language(s)
  • Business minded. A positive, energetic, self-motivated personality, able to explain complex legal points to business leaders with varying degrees of sophistication about legal matters; able to take business leaders’ concerns and demands into account in how best to pursue legal strategies. Intelligent and articulate with excellent written and verbal communication skills; nimble and quick-minded; able and willing to engage in debate
  • A team player that is able to command the respect of, and influence, business leaders and outside counsel across a wide spectrum of experience and sophistication. Able to work effectively with lower level employees, yet communicate with effectiveness and polish at the most senior levels
  • High integrity and ethics in all dealings – internal, external and personal; non-political in conduct, while understanding internal and external dynamics
  • Humility and humor coupled with the highest professionalism for the company is necessary
